The impact of the contract for the provision of services in Colombia

Abstract

This paper aims to demonstrate the importance and necessity of adequate regulation of the contract for services provision. It delves into how clear and effective legislation can significantly improve working conditions and protect the rights of those operating under this type of contract.

The contract for services provision constitutes an essential component of the Colombian labor structure, facilitating flexible collaboration between professionals and organizations without creating a labor link in the traditional sense. While it is true that this contractual "model" is not specifically regulated, a legal framework has been provided designed to balance the autonomy of the parties involved with adequate protection of workers' rights. However, a comparison with the regulatory frameworks of Mexico and Argentina reveals the need to strengthen Colombian legislation in this area.
The research is structured in two phases: a descriptive phase that details the characteristics and regulations in the three countries, and an argumentative phase that evaluates the practical consequences of these regulations.
The study concludes by stressing the importance of adapting and strengthening existing legislation to ensure that service provision contracts offer equitable protection and respond to the demands of the modern labor market.
