Abstract

The right to defense and due process in Colombia are two fundamental principles that guarantee the protection of individual rights in the judicial sphere. On the one hand, the right to defense implies that every person has the fundamental right to be assisted by a lawyer from the moment he or she is linked to a criminal process, and on the other, due process is a legal principle that guarantees that judicial proceedings are carried out in a fair, equitable and impartial manner. Therefore, this document is based on explaining in detail through examples, illustrations, and real cases, the way in which Colombian citizens, protected by legal regulations, can defend themselves against a criminal process against them, through the collection and presentation of material evidence and physical evidence in court The important contribution of digital evidence is also explained, which plays a fundamental role by providing, through specialized software and digital tools, clear and persuasive visual representations related to the facts of the investigation, which facilitates the understanding and evaluation of the material evidence and physical evidence.
